  1. Collection and storage of personal data as well as type and purpose of their use

a) When visiting the website

When you visit our website, the browser used on your terminal device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automated deletion:

  • IP address
  • Date and time of the request
  • Time zone difference from Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Amount of data transferred in each case
  • Website from which the request comes
  • Browser type and version
  • Operating system and its interface
  • Language and version of the browser software
  • Name of the requested website
  • Message about successful retrieval

The aforementioned data will be processed by us for the following purposes:

  • Ensuring a smooth connection of the website,
  • Ensuring a comfortable use of our website,
  • evaluation of system security and stability, and
  • for further administrative purposes.

The legal basis for data processing is Art. 6 para. 1 p. 1 lit. f DSGVO. Our legitimate interest follows from the purposes for data collection listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person.

In addition, we use cookies and analysis services when you visit our website. You can find more detailed explanations of this under points 5 and 6 of this data protection declaration.

b) When registering for our newsletter

If you have expressly consented in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO, we will use your e-mail address to send you our newsletter on a regular basis. For the receipt of the newsletter, the specification of an e-mail address is sufficient.

Unsubscribing is possible at any time, for example via a link at the end of each newsletter. Alternatively, you are welcome to send your unsubscribe request at any time by e-mail to info@datentreiber.de.

c) When booking a seminar/workshop

If you make a binding booking for a seminar or workshop via our website, we require your full contact details (surname, first name, company, address, communication data (telephone and e-mail address)) for order processing. We then use this data internally with the help of our subcontractors named in point 3.1. of this declaration in order to be able to provide the desired service for you. Furthermore, commercial letters are of course also generated and, finally, documents relevant for our accounting department are created and processed. You will receive the invoice automatically by electronically sent invoice via our service provider.

Data processing for the purpose of booking a service (seminar, workshop) via our website and by e-mail is based on your voluntarily given consent in accordance with Art. 5 para. 1 p. 1 lit. A DSGVO.

Your personal data will not be transferred to third parties for purposes other than those listed below.

We will only share your personal information with third parties if:

  • the disclosure is necessary in accordance with Art. 6 (1) p. 1 lit. f DSGVO for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
  • in the event that a legal obligation exists for the disclosure pursuant to Art. 6 (1) sentence 1 lit. c DSGVO, or
  • this is legally permissible and necessary according to Art. 6 para. 1 p. 1 lit. b DSGVO for the processing of contractual relationships with you.

3.1 Our subcontractors

We try to make our internal work processes as efficient and simple as possible. In doing so, we naturally pay strict attention to compliance with applicable data protection laws and guidelines when selecting our partners. Our subcontractors are current:

ALL-INKL.COM – Neue Medien Münnich (all-inkl.com), our hosting provider: all popular websites we operate are hosted by this service provider.

  • David Drexler (whatsbold.com) is our web developer and creates as well as maintains our website.
  • Kemb GmbH (https://wearekemb.com) is our marketing agency and is responsible for performance marketing, social media marketing, content marketing, newsletter marketing, search engine marketing and CRM marketing.
  • Pipedrive (pipedrive.com) is our CRM provider. Here we store all customer contacts and customer communication for traceability.
  • FastBill (fastbill.com) is our SaaS provider for accounting, quoting and billing.
  • snapADDY (snapaddy.com) is used to copy contact data from email signatures, from business cards, from the imprint of companies, as well as from social networks such as XING and LinkedIn (provided we have contact clearance) and store them in Pipedrive with the aim of optimizing communication with customers and partners and to create quotes and invoices in FastBill.
  • Google Analytics (google.com) is our web analytics provider. We use the analytics from Google Analytics to optimize our website and content.
  • Microsoft Office & Exchange 365 (office.com) provides us with programs and servers for email communication (Outlook & Exchange) and, among other things, for document creation (Word – for business letters), and we use the SharePoint and OneDrive products for storing and synchronizing files and documents between different computers, employees, customers and partners.
  • CleverReach (www.cleverreach.com) is a newsletter marketing service that we use for our newsletter.
  • Airtable (www.airtable.com) is an online database service that we use for our surveys as well as databases, templates, etc. (see Library).
  • Creatlr (www.creatlr.com) is an online service for our collaboration tools (“Canvas”). We embed examples, templates, etc. from Creatlr on our website.
  • YouTube (www.youtube.com) is an online video portal that we use to share videos from our talks, webinars, etc. as embeds on our website, among other things.
  • Cookiebot (www.cookiebot.com) is an online service to manage our cookies and display the cookie banner.
  • Calendly (www.calendly.com) is an online appointment booking tool to make appointments.
  1. Unsolicited applications

You are welcome to send us unsolicited applications. Please ensure that the transmission method you choose is sufficiently secure. Sending an e-mail without a suitable encryption method is not recommended, as your data could then also be read and used by unauthorized persons on the communication path without much effort. If you would like to send us an encrypted e-mail with application documents, please only use the e-mail address info@datentreiber.de.

  1. Analysis tools

a) Tracking-tools

The tracking measures listed below and used by us are carried out on the basis of Art. 6 (1) p. 1 lit. f DSGVO. With the tracking measures used, we want to ensure a needs-based design and continuous optimization of our website. On the other hand, we use the tracking measures to statistically record the use of our website and evaluate it for the purpose of optimizing our offer for you. These interests are considered legitimate in the sense of the aforementioned provision.

i) Google Analytics

For the purpose of demand-oriented design and ongoing optimization of our pages, we use Google Analytics, a web analytics service provided by Google Ireland Limited (https://www.google.de/intl/de/about/) (Gordon House, Barrow Street, Dublin 4, Ireland; hereinafter “Google”). In this context, pseudonymized usage profiles are created and cookies (see under point 4) are used. The information generated by the cookie about your use of this website such as.

This information may also be transferred to third parties if this is required by law or if third parties process this data on our behalf. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymized so that an assignment is not possible (IP masking). All stored data is automatically deleted after 14 months.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.

You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=de).

As an alternative to the browser add-on, especially for browsers on mobile devices, you can also prevent the collection by Google Analytics by clicking on this link. ii) Google Adwords Conversion Tracking

In order to statistically record the use of our website and to evaluate it for the purpose of optimizing our website for you, we also use Google Conversion Tracking. In this process, Google Adwords sets a cookie (see section 5) on your computer if you have accessed our website via a Google ad.

These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer’s website and the cookie has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page.

Each Adwords customer receives a different cookie. Cookies can therefore not be tracked across Adwords customers’ websites. The information obtained using the conversion cookie is used to create conversion statistics for Adwords customers who have opted for conversion tracking. The Adwords customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

If you do not wish to participate in the tracking process, you can also refuse the setting of a cookie required for this – for example, via a browser setting that generally disables the automatic setting of cookies. You can also disable cookies for conversion tracking by setting your browser to block cookies from the “www.googleadservices.com” domain. iii) Use of Google Remarketing

We use the Google Remarketing, hereinafter “Google”, on our website. With Google Remarketing, ads can be placed for users who have already visited our website in the past. Within the Google advertising network, this allows advertisements to be displayed on our site that are tailored to their interests. Google remarketing uses cookies for this evaluation. Cookies are small text files that are stored on your computer and allow an analysis of the use of the website. This makes it possible to recognize our visitors as soon as they call up websites within Google’s advertising network. In this way, advertisements can be presented within the Google advertising network that are related to content that the visitor has previously accessed on websites of the Google advertising network that also use Google’s remarketing function. According to Google, Google does not collect any personal data in this context. You can deactivate this function by making the appropriate settings at https://www.google.com/settings/ads.

iv) Use of Facebook Remarketing

Due to our legitimate interests in the analysis, optimization and economic operation of our online offer and for these purposes, the so-called “Facebook pixel” of the social network Facebook is used on our pages. Facebook is certified under the Privacy Shield agreement and thus offers a guarantee of compliance with European data protection law. With the help of the Facebook pixel, it is possible for Facebook to determine the visitors to our offer as a target group for the display of ads (so-called “Facebook ads”). Accordingly, we use the Facebook pixel to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our online offer. With the help of the Facebook pixel, we also want to ensure that our Facebook ads correspond to the potential interest of the users and do not have a harassing effect. The Facebook pixel is used by us for the effectiveness of the Facebook ads and for statistical and market research purposes.

The processing of data by Facebook takes place within the framework of Facebook’s data usage policy. You can object to the collection by the Facebook pixel and use of your data to display Facebook ads. To adjust which types of ads are displayed to you within Facebook, you can visit the page set up by Facebook and follow the instructions there regarding the settings for usage-based advertising: https://www.facebook.com/settings?tab=ads. The settings are platform-independent, i.e. they are applied to all devices, such as desktop computers or mobile devices.

  1. Social Media Plug-ins

We use social plug-ins of the social networks Facebook, Twitter and Instagram on our website on the basis of Art. 6 (1) p. 1 lit. f DSGVO in order to make our company better known. The underlying promotional purpose is to be considered a legitimate interest within the meaning of the DSGVO. The responsibility for data protection compliant operation is to be ensured by their respective providers. The integration of these plug-ins by us takes place by way of the so-called two-click method in order to protect visitors to our website as best as possible.

a) LinkedIn

Our website uses functions of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. Each time one of our pages containing LinkedIn functions is accessed, a connection to LinkedIn servers is established. LinkedIn is informed that you have visited our web pages with your IP address. If you click the “Recommend Button” of LinkedIn and are logged into your account at LinkedIn, it is possible for LinkedIn to assign your visit to our website to you and your user account. We point out that we as the provider of the pages have no knowledge of the content of the transmitted data and its use by LinkedIn.

b) Slideshare

We use components of the provider Slideshare.com on our site. This offer is a service of SlideShare Inc., 1 Montgomery St., Suite 1300, San Francisco, CA 94104, and is integrated into our site by a so-called 2-click solution. By simply visiting our site, no personal data is passed on to the provider Slideshare.com.  Only if the start of the components of the provider Slideshare.com is manually triggered by you, personal data will be transmitted to Slideshare.com, Google Analytics and ComScore and stored in the USA. Furthermore, a cookie is set in your browser. We have no influence whatsoever on the data collected by the provider Slideshare.com and its data processing procedures. We are also not aware of the full extent of the data collection, its purposes or any storage period specified by Slideshare.com. c) ComScore

ComScore (Corporate Headquarters Reston, 11950 Democracy Drive, Suite 600, Reston, VA 20190) stores the data thus obtained in the form of a “user profile”. An evaluation of this “user profile” on the part of ComScore is carried out for the provision of needs-based advertising and/or market research. You have the right to object to the creation and storage of these user profiles by ComScore. d) YouTube

On our website, the service “YouTube” is used to embed videos on our website. The operator of the software required for this is Google Ireland Limited Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland.

The integration of YouTube content takes place in “extended data protection mode”. This ensures that YouTube does not initially store any cookies on your device. As a result, YouTube no longer stores any information about visitors as long as you do not watch the video.

The legal basis of the processing is your consent pursuant to Art. 6 (1) lit. a DSGVO. In the context of processing via YouTube, data may be transmitted to the USA, in particular to Google LLC and Alphabet Inc.

You have the right:

  • in accordance with Art. 15 DSGVO to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;
  • in accordance with Art. 16 DSGVO to immediately demand the correction of incorrect or completion of your personal data stored by us;
  • pursuant to Art. 17 DSGVO to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;
  • to request the restriction of the processing of your personal data in accordance with Art. 18 DSGVO, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing in accordance with Art. 21 DSGVO;
  • pursuant to Art. 20 DSGVO to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller;

In the latter case, you have a general right of objection, which is implemented by us without specifying a particular situation.
